#JOHESUStrike2018 Suspension Update: JOHESU Writes To The DG DSS On The Actions Of @IsaacFAdewole
Date Posted: 13/Jun/2018
In a letter sent to the DG of the DSS dated 11th of June 2018, the Executives of JOHESU expressed their displeasure and surprise at the actions of the Minister for Health Prof. Isaac Adewole concerning the NO Work No Pay Order.
The letter reads:
We wish to draw your attention to the attached circular Issued by the Honourable Minister of Health, Federal Ministry of health to CMD/MDS/CEO of Federal Tertiary Health Institutions of Nigeria.
You may wish to recall that the Joint Health Sector Unions (J0HESU) suspended its strike after your intervention and court ruling in suit No. NICN/ABJ/138/2018 of 307' May, 2018 Instituted at the National Industrial Court of Nigena.
The court ordered the parties to resolve the issues through processes of mediation/conciliation of the Alternative Dispute Resolution of the Court and specifically ordered that:
NO Party shall in the course of this negotiation do anything that will jeopardize the peace at the work place environment.
Please see. Order 12 of the Ruling as per the Enrolment Order.
The attached Circular issued on 5th June, 2018 after the process of the mediation/conciliation has been ordered and commenced, Is a clear breach and violation of the Order of the Court and it amounts to strong arm tactics by the Minister of health against our members.
The dictate of this circular, smacks of complete bad faith on the part of the Honourable Minister of Health and completely overreaching of all the efforts so far taken by all the parties towards the suspension of the stoke and amicable settlement of the dispute by all concerned.
Further to the foregoing, It is to be recalled and even on record before the court that all the parties to this dispute consented to al the Orders of the Court as contained In the Enrolment of Order dated 30th May, 2018 under reference, is to say the least, unwarranted in view of the aforesaid circumstances. We can only reiterate further and for purposes of emphasis that order 11 at page 3 of the enrolment of Order stated In clear and unambiguous terms as follows:
All the parties concerned are hereby directed to put the country first in the negotiation with the aim of reaching amicable settlement.
The enforcement of the "NO WORK, NO PAY" and non-payment al April and May, 2018, salaries to our members has caused tension within the rank and file of our members which has further exacerbated the already fragile peace at the work place.
Suffice it to say therefore, that the letter of the Federal Ministry of Health is nothing short of a deliberate attempt to further stoke the fire of the dispute and re-Ignite the crisis hereby put the Nation into chaos and crisis. Simply put, the blame for whatever happens thereafter should be put at the doorsteps of the Honourable Minister of Health.
In view of the impending damage that this circular letter may cause, we most humbly request the Director General to use your good office to advise the Honourable Minister of Health to withdraw the circular immediately to allow the Order of the Court to be carried out in the interest of peace and overall security of the Nation at this point in time.
The purpose of this letter to you therefore, is to request that you use you good offices to prevail on the Federal Ministry of Health, particularly, the Hon. Minister, to release the payment of April and May 2018 salaries of our members so as to douse the tension at the work place environment and sustain the industrial peace that has returned please.
